Terms of service

These terms apply when you buy anything from us. We've written them in plain English. Where a section only applies to one service, it says so.

1. About us and these terms

1.1 We’re websyte, the trading name of [owner’s name – to be added], a sole trader. You can contact us at hello@websyte.uk. Our address for formal notices is [address for notices – to be added].

1.2 "We", "us" and "our" mean websyte. "You" means the person or business buying from us.

1.3 Some parts of these terms apply differently depending on whether you're a consumer (buying for yourself, not for a business) or a business customer. Where that matters, we say so. Nothing in these terms takes away your legal rights as a consumer.

1.4 Our Acceptable use policy and Privacy policy also apply.

2. Our services

We provide:

  • Pay monthly websites: we design, build, host and look after a website for you for a monthly fee. The fee covers your website, domain, email, hosting, backups and ongoing maintenance (section 6).
  • One page websites: a single-page website built from a template, for a one-off price, with your domain and hosting included for the first 12 months (section 7).
  • Web hosting: the Essential, Pro and Super plans (section 8).
  • Domain names: registration, renewal and management (section 9).

3. Ordering

3.1 Hosting and domains: our contract starts when you complete your order in our client area at my.websyte.uk and we confirm it.

3.2 Pay monthly websites: we agree your monthly price and what's included with you before we start. The contract starts when you accept our quote and pay your first month.

3.3 One page websites: you request a website through our preview form. We send you a preview, usually within two working days. The contract starts when you ask us to go ahead.

4. Prices and paying

4.1 We're not VAT registered, so the prices we show are the prices you pay. There's no VAT to add.

4.2 There's no setup fee. For monthly services, the first month is paid upfront, then you pay monthly on the same date each month.

4.3 Hosting can be paid monthly, every 12 months or every 24 months. The price for each billing period is shown on our website and at checkout. Paying for a longer period costs less overall.

4.4 Where a free trial is offered, the length of the trial and the price afterwards are shown at checkout. If you don't cancel before the trial ends, the plan carries on at that price.

4.5 Invoices are issued through our client area. If a payment fails or is late, we'll remind you. If it's still unpaid 14 days after the due date, we may suspend the service until it's paid. We'll warn you before we do. Suspending a service doesn't end the contract.

5. Your right to cancel (consumers)

5.1 If you're a consumer and you bought online or at a distance, you normally have 14 days to change your mind, starting from the day the contract starts.

5.2 If you ask us to start work or start a service within those 14 days, for example by setting up hosting straight away, you'll need to pay for what we've provided up to the point you cancel.

5.3 Domain registrations can't be cancelled once the domain has been registered, because the registration is made specifically for you.

5.4 To cancel, just email hello@websyte.uk.

6. Pay monthly websites

6.1 Your price. We agree your monthly price before we start, based on what you need. It normally stays the same for as long as you stay. A higher price may be agreed at the start for special requirements, such as an online shop or a lot of storage. In rare cases we may need to review it if your use becomes exceptional, for example a mailbox that's never archived and fills its storage. We'll always talk to you first, and you can leave instead (6.5).

6.2 What's included. Your website, domain, email, hosting, backups and ongoing maintenance, as agreed in your quote.

6.3 Your domain. We register your domain in our name for the first 12 months. After 12 months we transfer it into your name. We keep managing it for you while you stay.

6.4 Nothing changes at 12 months. The service carries on as normal at the same monthly price. Ownership only matters if you decide to leave (6.5).

6.5 Leaving. You can leave at any time. There's no minimum term and no notice period. Just get in touch by email, WhatsApp or a ticket in the client area. The service ends at the end of the month you've paid for, and we don't refund part-months.

  • If you leave after 12 months, your website and your domain are yours. If you want it, we'll send you all your website data and help you move your domain.
  • If you leave before 12 months, the website design and build and the domain stay with us. We'll send you back the content you gave us, such as your text and photos, if you ask.

6.6 Your content. You keep ownership of the content you give us, such as text, photos and logos. You give us permission to use it to build and run your website.

7. One page websites

7.1 The price. One page websites are a one-off price, shown on our website. You pay once the website is ready and you're happy with it.

7.2 Changes. Two rounds of changes are included before you sign the website off. Updates after launch are charged at the fixed price per update shown on our website.

7.3 Ownership. The website and the domain are yours from day one, and the domain is registered in your name from the start.

7.4 Domain and hosting. Your domain is free for the first year, and hosting is included for 12 months. After that, your domain and hosting renew together each year at the renewal price shown on our website. If you'd rather not renew, tell us before the renewal date and we'll help you move your website and domain elsewhere.

7.5 Upgrading to pay monthly. If you upgrade to a pay monthly website during your first year, we'll credit the unused part of your one-off price: one-twelfth of it for each full month left of your first year. After 12 months there's nothing left to credit.

8. Web hosting

8.1 Each hosting plan has the limits shown on our website, such as storage, websites and email accounts. You can upgrade or downgrade at any time in the client area.

8.2 Hosting must be used fairly and in line with our Acceptable use policy. If your use affects other customers, we'll contact you and help you find a plan that fits. In an emergency we may limit an account first to protect other customers.

8.3 We take daily backups, but backups are there for emergencies. Please keep your own copy of anything important.

8.4 You can cancel hosting at any time in the client area or by getting in touch. It ends at the end of the billing period you've paid for. When hosting ends, we delete the account and its data within 30 days. Please download anything you need before then.

9. Domain names

9.1 Domains are registered under the rules of the registry for each domain ending, such as Nominet for .uk domains. You agree to follow those rules. You must give accurate contact details, and keep them up to date.

9.2 Domains renew every year unless you tell us otherwise. We'll remind you before a domain is due. If a renewal isn't paid, the domain may expire and could be registered by someone else.

9.3 Domains you buy on their own, and one page website domains, are registered in your name and you can move them elsewhere at any time. For pay monthly websites, section 6.3 applies.

9.4 We can't guarantee a domain is available until it has been registered, and we're not responsible if a registry refuses or cancels a registration.

10. Your responsibilities

You must:

  • give us accurate information and keep your contact details up to date;
  • keep your client area and hosting passwords safe;
  • make sure you have the rights to any content you give us or put on your website;
  • follow our Acceptable use policy and the law, including any data protection rules that apply to your own website.

11. Our responsibilities

11.1 We'll provide our services with reasonable care and skill.

11.2 We work hard to keep everything running, but we can't promise that services will never be interrupted. Sometimes we need to carry out maintenance. We'll warn you about planned work where we can, and try to do it at quiet times.

12. Suspending or ending a service

12.1 We may suspend or end a service, after warning you where we reasonably can, if:

  • you don't pay (see 4.5);
  • you seriously or repeatedly break these terms or our Acceptable use policy;
  • we have to by law, or a registry requires it.

12.2 If something puts our systems or other customers at immediate risk, such as malware or an attack, we may act straight away and then tell you.

13. Our liability

13.1 Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be limited by law.

13.2 Consumers: we're responsible for loss or damage you suffer that's a foreseeable result of us breaking these terms or not using reasonable care and skill. We're not responsible for losses that weren't foreseeable.

13.3 Business customers: we're not liable for loss of profits, sales, business or data, or for indirect losses. Our total liability in any 12 months is limited to the amount you paid us in that period.

14. Changes to these terms

We may update these terms from time to time, for example when the law changes or we change our services. If a change affects you significantly, we'll tell you by email at least 30 days before it takes effect, and you can leave without any charge if you're unhappy with it.

15. Complaints and the law

15.1 If something goes wrong, please tell us. See our Complaints procedure.

15.2 These terms are governed by the law of England and Wales. If you're a consumer living in Scotland or Northern Ireland, you can also bring a claim in your local courts.
